Anti-Free Speech Obama; Pro-Islamic Obama

Jonathan Turley noted in an important article that Obama has sided with a U.N. Muslim effort to stifle free speech. In his advocacy of restricting free speech Obama joined Egypt in sponsoring the non-binding admonition not to criticize Islam. As Doug Mataconis points out at Below the Beltway, there is no room in a free society for laws restricting freely expressed or held views against any religion, as the Supreme Court made clear in the 1952 case Burstyn v. Williams:

[F]rom the standpoint of freedom of speech and the press, it is enough to point out that the state has no legitimate interest in protecting any or all religions from views distasteful to them which is sufficient to justify prior restraints upon the expression of those views. It is not the business of government in our nation to suppress real or imagined attacks upon a particular religious doctrine, whether they appear in publications, speeches, or motion pictures.

It is very disconcerting that a sitting American president would join hands with a Muslim military dictatorship to stifle free speech.

Obama et. al., get a flu shot but no swine flu vaccination.

Many Americans wondered what they should do because of the swine flu pandemic.

Americans may be receiving direction from an unusual source of which they may not be completely aware. A prime time ABC drama show that aired last week featured a subliminal message that encouraged people to take the swine flu shot. The campaign to sell people on the government’s health agenda is widespread and includes suggestive messages implanted in network TV broadcasts.

There is a series of screen shots from the science-fiction series FlashForward which is currently airing. The scene occurs 26 minutes 30 seconds into the fourth episode, which was broadcast on 15 October 2009.

The image shows a computer screen and on it a web page with a prominently featured advertisement that reads, “Time for Your Flu Shot.” Another ad immediately to the right of this reads, “Take It Now!”

The web page was obviously manufactured deliberately for the scene because the URL in the address bar is not a real website.

WH Communications Director Tells International Audience: "Controlled" Press


Obama's presidential campaign focused on "making" the news media cover certain issues while rarely communicating anything to the press unless it was "controlled," White House Communications Director Anita Dunn disclosed to the Dominican government at a videotaped conference.

"Very rarely did we communicate through the press anything that we didn't absolutely control," said Dunn.

"One of the reasons we did so many of the David Plouffe videos was not just for our supporters, but also because it was a way for us to get our message out without having to actually talk to reporters," said Dunn, referring to Plouffe, who was Obama's chief campaign manager.

"We just put that out there and made them write what Plouffe had said as opposed to Plouffe doing an interview with a reporter. So it was very much we controlled it as opposed to the press controlled it," Dunn said.

Continued Dunn: "Whether it was a David Plouffe video or an Obama speech, a huge part of our press strategy was focused on making the media cover what Obama was actually saying as opposed to why the campaign was saying it, what the tactic was. … Making the press cover what we were saying."

Dunn was speaking at a Jan. 12, 2009, event focusing on Obama's media tactics and hosted by the Global Foundation for Democracy and Development, which seeks to promote collaboration between the U.S. and the Dominican Republic. The event was held in Santo Domingo and was attended by the country's president.

Thank you very much for inviting me.

I come to America with a mission. All is not well in the old world. There is a tremendous danger looming, and it is very difficult to be optimistic. We might be in the final stages of the Islamization of Europe. This not only is a clear and present danger to the future of Europe itself, it is a threat to America and the sheer survival of the West. The United States as the last bastion of Western civilization, facing an Islamic Europe.

First I will describe the situation on the ground in Europe. Then, I will say a few things about Islam. To close I will tell you about a meeting in Jerusalem.

The Europe you know is changing.

You have probably seen the landmarks. But in all of these cities, sometimes a few blocks away from your tourist destination, there is another world. It is the world of the parallel society created by Muslim mass-migration.

All throughout Europe a new reality is rising: entire Muslim neighborhoods where very few indigenous people reside or are even seen. And if they are, they might regret it. This goes for the police as well. It's the world of head scarves, where women walk around in figureless tents, with baby strollers and a group of children. Their husbands, or slaveholders if you prefer, walk three steps ahead. With mosques on many street corners. The shops have signs you and I cannot read. You will be hard-pressed to find any economic activity. These are Muslim ghettos controlled by religious fanatics. These are Muslim neighborhoods, and they are mushrooming in every city across Europe . These are the building-blocks for territorial control of increasingly larger portions of Europe, street by street, neighborhood by neighborhood, city by city.

There are now thousands of mosques throughout Europe. With larger congregations than there are in churches. And in every European city there are plans to build super-mosques that will dwarf every church in the region. Clearly, the signal is: we rule.

Many European cities are already one-quarter Muslim: just take Amsterdam, Marseille and Malmo in Sweden. In many cities the majority of the under-18 population is Muslim. Paris is now surrounded by a ring of Muslim neighborhoods. Mohammed is the most popular name among boys in many cities.

In some elementary schools in Amsterdam the farm can no longer be mentioned, because that would also mean mentioning the pig, and that would be an insult to Muslims.

Many state schools in Belgium and Denmark only serve halal food to all pupils. In once-tolerant Amsterdam gays are beaten up almost exclusively by Muslims. Non-Muslim women routinely hear 'whore, whore'. Satellite dishes are not pointed to local TV stations, but to stations in the country of origin.

In France school teachers are advised to avoid authors deemed offensive to Muslims, including Voltaire and Diderot; the same is increasingly true of Darwin . The history of the Holocaust can no longer be taught because of Muslim sensitivity.

In England sharia courts are now officially part of the British legal system. Many neighborhoods in France are no-go areas for women without head scarves. Last week a man almost died after being beaten up by Muslims in Brussels, because he was drinking during the Ramadan.

Jews are fleeing France in record numbers, on the run for the worst wave of anti-Semitism since World War II. French is now commonly spoken on the streets of Tel Aviv and Netanya, Israel. I could go on forever with stories like this. Stories about Islamization.

A total of fifty-four million Muslims now live in Europe. San Diego University recently calculated that a staggering 25 percent of the population in Europe will be Muslim just 12 years from now. Bernhard Lewis has predicted a Muslim majority by the end of this century.

Now these are just numbers. And the numbers would not be threatening if the Muslim-immigrants had a strong desire to assimilate. But there are few signs of that. The Pew Research Center reported that half of French Muslims see their loyalty to Islam as greater than their loyalty to France. One-third of French Muslims do not object to suicide attacks. The British Centre for Social Cohesion reported that one-third of British Muslim students are in favor of a worldwide caliphate. Muslims demand what they call 'respect'. And this is how we give them respect. We have Muslim official state holidays.

The Christian-Democratic attorney general is willing to accept sharia in the Netherlands if there is a Muslim majority. We have cabinet members with passports from Morocco and Turkey.

Muslim demands are supported by unlawful behavior, ranging from petty crimes and random violence, for example against ambulance workers and bus drivers, to small-scale riots. Paris has seen its uprising in the low-income suburbs, the banlieus. I call the perpetrators 'settlers'. Because that is what they are. They do not come to integrate into our societies; they come to integrate our society into their Dar-al-Islam. Therefore, they are settlers.

Much of this street violence I mentioned is directed exclusively against non-Muslims, forcing many native people to leave their neighborhoods, their cities, their countries. Moreover, Muslims are now a swing vote not to be ignored.

The second thing you need to know is the importance of Mohammed the prophet. His behavior is an example to all Muslims and cannot be criticized. Now, if Mohammed had been a man of peace, let us say like Ghandi and Mother Theresa wrapped in one, there would be no problem. But Mohammed was a warlord, a mass murderer, a pedophile, and had several marriages - at the same time. Islamic tradition tells us how he fought in battles, how he had his enemies murdered and even had prisoners of war executed. Mohammed himself slaughtered the Jewish tribe of Banu Qurayza. If it is good for Islam, it is good. If it is bad for Islam, it is bad.

Let no one fool you about Islam being a religion. Sure, it has a god, and a here-after, and 72 virgins. But in its essence Islam is a political ideology. It is a system that lays down detailed rules for society and the life of every person. Islam wants to dictate every aspect of life. Islam means 'submission'. Islam is not compatible with freedom and democracy, because what it strives for is sharia. If you want to compare Islam to anything, compare it to communism or national-socialism, these are all totalitarian ideologies.

Now you know why Winston Churchill called Islam 'the most retrograde force in the world', and why he compared Mein Kampf to the Quran. The public has wholeheartedly accepted the Palestinian narrative, and sees Israel as the aggressor. I have lived in this country and visited it dozens of times. I support Israel. First, because it is the Jewish homeland after two thousand years of exile up to and including Auschwitz, second because it is a democracy, and third because Israel is our first line of defense.

This tiny country is situated on the fault line of jihad, frustrating Islam's territorial advance. Israel is facing the front lines of jihad, like Kashmir, Kosovo, the Philippines , Southern Thailand, Darfur in Sudan , Lebanon , and Aceh in Indonesia. Israel is simply in the way. The same way West-Berlin was during the Cold War.

The war against Israel is not a war against Israel. It is a war against the West. It is jihad. Israel is simply receiving the blows that are meant for all of us. If there would have been no Israel, Islamic imperialism would have found other venues to release its energy and its desire for conquest. Thanks to Israeli parents who send their children to the army and lay awake at night, parents in Europe and America can sleep well and dream, unaware of the dangers looming.

Many in Europe argue in favor of abandoning Israel in order to address the grievances of our Muslim minorities.. But if Israel were, God forbid, to go down, it would not bring any solace to the West It would not mean our Muslim minorities would all of a sudden change their behavior, and accept our values. On the contrary, the end of Israel would give enormous encouragement to the forces of Islam. They would, and rightly so, see the demise of Israel as proof that the West is weak, and doomed. The end of Israel would not mean the end of our problems with Islam, but only the beginning. It would mean the start of the final battle for world domination. If they can get Israel, they can get everything. So-called journalists volunteer to label any and all critics of Islamization as a 'right-wing extremists' or 'racists'. In my country, the Netherlands, 60 percent of the population now sees the mass immigration of Muslims as the number one policy mistake since World War II. And another 60 percent sees Islam as the biggest threat. Yet there is a danger greater danger than terrorist attacks, the scenario of America as the last man standing. The lights may go out in Europe faster than you can imagine. An Islamic Europe means a Europe without freedom and democracy, an economic wasteland, an intellectual nightmare, and a loss of military might for America - as its allies will turn into enemies, enemies with atomic bombs. With an Islamic Europe, it would be up to America alone to preserve the heritage of Rome, Athens and Jerusalem.

Dear friends, liberty is the most precious of gifts. My generation never had to fight for this freedom, it was offered to us on a silver platter, by people who fought for it with their lives. All throughout Europe , American cemeteries remind us of the young boys who never made it home, and whose memory we cherish. My generation does not own this freedom; we are merely its custodians. We can only hand over this hard won liberty to Europe 's children in the same state in which it was offered to us. We cannot strike a deal with mullahs and imams. Future generations would never forgive us. We cannot squander our liberties. We simply do not have the right to do so.

We have to take the necessary action now to stop this Islamic stupidity from destroying the free world that we know.

No one seemed to check the paperwork as employers do but the woman who Obama hailed from the podium as someone seeking employment was convicted of drug fraud. Perhaps that has something to do with her unemployed status.

Sessions to Senate: Don't Rubberstamp Progressive Kagan Nomination for Obama


Sen. Sessions encouraged his Democrat colleagues in the Senate to carefully scrutinize Obama's nomination of Elena Kagan to the Supreme Court. Sessions argued that Kagan is a legal progressive and stated that the American people do not want Senators to confirm a Supreme Court nominee who would impose their own social or political views from the bench, and that such a philosophy is contrary to our legal heritage. Kagan does not believe in the American Constitution.

Jindal Calls Obama’s Actions in Gulf a ‘War’ on Louisiana

Governor Bobby Jindal gives a speech at the Rally For Economic Survival in Lafayette, Louisiana. Over 11,000 people gathered at the Cajun Dome to protest what they say is an assault on Louisiana’s economy by President Barack Obama.

“The fact that the federal government can’t do its job shouldn’t cost thousands of Louisianans OUR jobs.”

Obama Once Again Makes Erroneous Claim That Foreign Entities Can Spend Unlimited Amounts in U.S. Elections

Obama incorrectly stated that a landmark campaign-finance ruling allows foreign entities to pour money into U.S. elections.

The Supreme Court’s 5-4 ruling in Citizens United vs. the FEC lifted restrictions on companies, unions, and other organizations, allowing them to make independent expenditures in political campaigns.

That ruling, however, did not allow corporations to contribute directly to a campaign or to coordinate expenditures with a campaign. Nor did the ruling lift existing law that blocks foreign contributions to political campaigns.

Under the FEC regulation 11 CFR 110.20(i): “A foreign national shall not direct, dictate, control, or directly or indirectly participate in the decision-making process of any person, such as a corporation, labor organization, political committee, or political organization with regard to such person's Federal or non-Federal election-related activities, such as decisions concerning the making of contributions, donations, expenditures, or disbursements in connection with elections for any Federal, State, or local office or decisions concerning the administration of a political committee.”

Further, federal law, under 2 USC 441-Sec. 441e, also prohibits foreign donations to political campaigns.

The evidence accumulated here reveals that foreign nationals from the Muslim world influenced our presidential election through illegal campaign contributions to Obama.

Police State for Christians in New Mexico


Bernalillo County Sheriff Deputy Jim Goff's July 17 comments recorded. Goff, an 18-year veteran deputy, was ordering the protesters to leave a sidewalk outside a pavilion in Albuquerque where the heavy-metal concert was scheduled to take place. He said the area was private property belonging to Hard Rock Casino and threatened to take the protesters to jail unless they vacated the pavilion area. Heavy-metal rocker Rob Zombie was performing at the pavilion, which has a 15,000 seat capacity and hosts large concerts. According to the Albuquerque Journal, the pavilion is on state trust land and owned by the state of New Mexico. It was leased to Bernalillo County in the 1990s. The county subleases the 15-acre tract of land to Live Nation, an entertainment company that operates the facility. Jeremy De los Santos, one of the protesters, told KRQE-TV 13 his group believed it was on public property because it was outside the pavilion. He admitted to arguing with deputies when asked to leave. De los Santos can be heard on video saying, "It's our constitutional right. These people are free right here to be out here, why can't we?" Goff argued with the Christian group as members recorded his comments, saying, "People don't want to see that. … You must have a crush on me, man. Are you like a gay homosexual or something like that? You keep filming me!" The protesters were taken down the street from the event, and one deputy with the last name of Allen ordered a protester to turn his video camera off.

Eliseo Medina, SEIU Vice President and Democratic Socialists of America Honorary Chair, was the lead speaker at last weekend's 2010 Netroots Nation discussion of Civil Rights in the Modern Era.

Here Medina tugs on the heartstrings and plays on the emotions as he urges the gathered, mainly young "progressives" to unite behind the illegal illegal immigrant community. Medina is very careful to blur the line between illegal immigrants and Latino Americans.

His message is that by exploiting the Latino vote, "progressives" can carry several key states in November. To do that, the left must portray any resistance to illegal immigration as an attack on all Latinos.

Physicist Declares Climate Change a Fraud


Physicist Dr. Denis Rancourt, a former professor and environmental science researcher at the University of Ottawa, has attacked the politicized global warming movement.

In a video released by Climate Depot, Dr. Rancourt declares that the entire man-made global warming movement is nothing more than a “corrupt social phenomenon.” “It is as much psychological and social phenomenon as anything else,” Rancourt, who has published peer-reviewed research, explained in a June 8, 2010 essay. “I argue that by far the most destructive force on the planet is power-driven financiers and profit-driven corporations and their cartels backed by military might; and that the global warming myth is a red herring that contributes to hiding this truth. Chris Miller: I think High Voltage was a combination of errors all of which I had nothing to do with. They did apologize, but it wasn't all their fault. Like I said, it was a combination. I was annoyed because the stage sound was great and you never know what' it's going to be like on a festival. It's frustrating to ravel 3,000 miles - to rehearse for a 35 minutes set - which somehow becomes 10 minutes. I hadn't even started. I felt bad for Andy, who came with me and I felt bad for all those people who came to see us. The whole thing got blown out of all proportion. I got angry - for about 30 seconds - what can you do?

Bill McCue: 'Great RH pic of you with Pagey at High Voltage. Do you two get on these days? I remember bad blood between Zep and MTH at the Uris in the 70's. Re: age - what's your secret?' Jimmy came to a MTH gig at Hammersmith but I wasn't able to meet him as I was leaving the stage and going straight back to the hotel to preserve the vocals. It was great he popped down to High Voltage with Ross. We had a couple of chats before and after the gig - he was genuinely nice. We never mentioned the Uris. We were talking about the real early days. My secret is Ross Halfin!

Agree that the Down'n'Outz and IH set turned out to be such a huge disappointment. Don't get me wrong... Joe and the Down'nOutz were brilliant. They seem to put more life and soul into some of the songs than the originals ever had live - and I do know - I have seen most of them live by Mott, British Lions, MTH and IH. They make you realise how good some of the more obscure or less popular songs were. The Quireboys are an exceptionally 'up' band and back Joe Elliot perfectly. If you get the chance, go and see them live. You won't regret it one bit. The problem at HV was the set length taking into account IH was meant to be a special guest. I must admit I was standing there thinking 'when are you bringin Ian on?' because I just knew they were running out of time. I think the brutal truth (sorry Joe) is that Joe just did too many songs before bringing Ian on stage, specially when you consider the last two before IH were true IH live classics. When Ian did come on with Andy York it was all a bit confused for a few minutes. Nobody quite seemed to know what they were doing - though that could well have been because Joe was getting hassle from the organisers. Two slightly uncomfortable songs later the PA system said 'thanks to the Down'n'Outz', followed by the band attempting another song to find all the PA system shut down. I really thought the crowd might be able to get another song out of the organisers but then the PA started playing recorded music and the stage hands were already pulling the equipment off the stage. A little entertainment followed when Ian raised his guitar ready to swipe at the organiser, but luckily realised his guitar was more valuable than the reults would have been worth. Nonetheless he still grabbed the organiser and started remonstrating with him. A waste of time though. Still - it did remind me of the last Hammersmith Odean gig by Mott, even though the result wasn't as satisfying. Nice to see Ian still has the old fighting spirit he always used to show though!

So... that was that. Really annoyed at the organisers at first but you have to say, they have a strict deadline for ending the day and ELP were the headliner. It wouldn't have been fair to them or the ELP fans to have their proper time cut short. The organisers really should have let IH and Joe at least say goodbye though, rather than just cutting power. That is unforgivable.
And, there was discussion about the incident on the High Voltage web site and the web site contact music also ran a story about the event. Finally, Classic Rock emailed an attendee (name redacted) as an explanation:

Thanks for your email. Your disappointment was shared by a lot of people, not least most of the Classic Rock staff. What appears to have happened is that Joe Elliott and co.'s set overran its allotted time. As the headliners (ELP) could not overrun to make up the time, due to a curfew that carried huge financial penalties (and possibly problems getting a licence for next year's event), Joe and ian had to come off before they had finished their planned set. They did, however, play for the amount of time they were scheduled to play. Maybe they timed their set wrongly.
Sorry for the disappointment, but it does appear to have been the artist(s) at fault, and not the festival organisers. .

Obama Lied About Lockerbie, Correspondence Withheld

Scottish government ministers, stung by accusations that they released Abdel Baset Ali Mohmed al-Megrahi, the only person convicted of the 1988 Pan Am Flight 103 bombing in which 270 people were killed, to ease a massive oil exploration contract in Libya, are pointing out that it is the U.S. government that is blocking the release of two documents relating to the decision.

One of the documents is a demarche and letter to Scottish First Minister Salmond from deputy chief of mission at the U.S. Embassy in London, Richard LeBaron, dated August 12, 2009, eight days before Megrahi was released.

Leaked to London’s Sunday Times this week, the letter reportedly argues that Megrahi should remain in custody – but goes on to say that if Scotland concludes he must be released, then doing so on compassionate grounds would be “far preferable” to his repatriation under a prisoner transfer agreement (PTA) which Britain negotiated with Libya in 2007.

The text verifies that Obama lied with his statement of the time that “all of us here in the United States were surprised, disappointed, and angry” about Megrahi’s release.

The second document which Scotland says the U.S. is withholding permission to make public is a note of a telephone conversation between Scottish justice minister Kenny MacAskill and Attorney General Eric Holder, apparently on June 26, 2009. The contents of that note remain secret.

My guess is that the American military has been advising Obama about these conditions, all to no avail. The soldiers who have been placed in harms way do not have the support that they need and deserve. The Pakistanis are two-faced and their involvement with America's enemies contrast sharply with the frequently optimistic public propaganda spoon fed to the American public. Pakistan is portrayed as an ally by American officials and we need their support to sustain a drone campaign over parts of Pakistani territory to strike at al-Qaeda havens. Clinton recently announced $500 million in assistance and called the United States and Pakistan “partners joined in common cause.”

Message from Frank Gaffney: The Center for Security Policy today unveiled a powerful 1-minute video opposing the construction of a 13-story, $100 million mega-mosque near the hallowed ground of the World Trade Center. The Twin Towers were destroyed on 9/11 by adherents to the barbaric, supremacist and totalitarian program authoritative Islam calls "Shariah." This year's poll also finds a 15-point drop in high confidence in the presidency, to 36% from 51% in June 2009. Over the same period, Obama's approval rating fell by 11 points, from 58% to 47%.

Another interesting statistic is that although confidence has been declining, which is the general trend, the top four highest ranked institutions have traditionally been associated with the right-wing in American politics: military, small business, police, and church or organized religion.

The military continues its long-standing run as the highest-rated U.S. institution. Small business and the police occupy second and third places, respectively. These three top-tier institutions all earn high confidence from a majority of Americans, something no other institution achieves this year.

The military has been No. 1 in Gallup's annual Confidence in Institutions list continuously since 1998, and has ranked No.1 or No. 2 almost every year since its initial 1975 measure.

Kagan: 1st Sharia (Islamic law) Compliant Supreme Court Justice?

To simply promote study about sharia law is not objectionable but Kagan has honored those who promote sharia law in Pakistan. Likewise, Kagan has been criticized for promoting Noah Feldman, author of The Fall and Rise of the Islamic State, but it is not the topic per se which is objectionable, the rise of Islamist states are an important area of study. It is rather what are Kagan, Feldman, and perhaps most importantly, Islamists advocating for the rise of Islamist states. In short, is it a good thing or a bad thing based on what I would argue is a radically opposed understanding of law as based on the American Constitution, having profound implications for the role of religion in society, the basis of citizenship, and the notion of natural rights.

Stated baldly, per Feldman, that the contemporary world is oddly enough experiencing a re-birth of Islamic states and is thus worthy of study, I whole-heartedly concur, although it is a trend I view warily. On the other hand, when Feldman asserts, as he does, that "Americans have never fully resolved the question of whether the inalienable rights of life, liberty, and property preexist the U.S. Constitution or derive from it " (Rise, p. 13), then I have to take issue with Feldman. The Founders believed inalienable rights arise from a Supreme Being or Power, i.e., God.

Feldman does develop his notion into an even more problematic area. He argues that an opposing (and I would argue one that is faithful to the American Constitution)

"viewpoint that emerges from inward looking constitutional thought is that international bodies (and hence, the law they produce) lack the legitimacy of direct, democratic procedures. The outward looking concept is characterized by the view that the constitution is the paradigm of the rule of law and should embody justice in governance. This view embraces international organizations as an institutional link between universal values of freedom and justice and the implementation of the rule of law." Cf. I believe you have the outlines demarcated between two substantially opposing viewpoints of the law. On the one hand, do natural rights precede individuals and are guaranteed by God? Or, does the law arise from a universally human and international understanding of justice? The first is the American understanding of life, liberty, and the pursuit of happiness while the latter is the international and contingent nature of humanly applied justice.

Professor Feldman, who joined the faculty of HLS in 2007, is a distinguished scholar in the areas of constitutional design, law and religion, and legal history. His most recent book, which examines the history of Sharia law, is titled The Fall and Rise of the Islamic State. His three previous books are Divided by God: America's Church and State Dilemma, What We Owe Iraq: War and the Ethics of Nation Building, and After Jihad, America and the Struggle for Islamic Democracy. His experience before joining the HLS faculty included a role as senior constitutional advisor to the Coalition Provisional Authority in Iraq and service as law clerk to Justice David Souter at the U.S. Supreme Court. 1. Wednesday, November 12, 9:30 - 10:15 am: The 20th century judiciary of the Muslim World: its historical emergence (Adel Omar SHERIF)

The purpose of this presentation is to shed light on the emergence and spread of the specialized model of the constitutional judiciary in a number of the Islamic countries during the last third of the 20th Century. We are going to highlight the interesting role it has been playing in shaping the constitutional, political, societal, economical dimensions of the systems of government and the citizens’ daily life of those countries through the noteworthy influence it has continuously left on the process of interpreting the constitutional and legislative texts, especially since the 1970s until today.

The scholarly literature is still debating whether the constitutional judiciary in the Muslim World has come into existence responding to public pressures, outside influence or true intentions on the rulers’ part to introduce effective judicial, and more democratic, reforms. These scholarly debates have led to different theories on the phenomenal evolution of the constitutional judiciary that reflects a progressive development of the legal thought in the Muslim World. These theories will be evaluated in the course of the presentation.

The increasing trend towards inscribing Islamic Shari’a principles into state constitutions in Islamic countries and the challenges that the constitutional judiciary has met with, in its attempt to enforce these norms, will be analyzed through an examination of its jurisprudence as it has evolved over the past forty years or so.

The introduction of the “Principles of the Islamic Shari’a” as a major source of the national legislation in the constitutions of major Muslim countries, 1970-2008 (Baber JOHANSEN)

The introduction of constitutional amendments in the 1970s and 1980 that made “the principles of the Islamic Shari’a” a major or even the major source of national legislation has, on the one hand, given a new Islamic dimension to constitutional law, it has, on the other, raised the question of the relation between this amendment and the other articles of the constitution. Is the Islamizing amendment an article above or in the constitution? Do all other articles of the constitution have to be interpreted in its light or is the constitution one body in which the new amendment has to be interpreted in a way that guarantees the rights and freedoms protected by the constitution? In the last instance the question is how, if the Islamizing amendment is above the rest of the constitution, the constitution can guarantee its status as being above the positive law and the constitution.

In the debates on constitutional law this question has been discussed in great detail and from multiple and contradictory positions. The discussion in this paper will center on the conditions under which this amendment has been introduced into the constitution of Pakistan, the constitution of Egypt and the constitution of the UAE and how the legal debates and the positions of the Supreme Courts differ with regard to this question.

The emergence of the constitutional judiciary in the Arab World

The introduction of a constitutional judiciary in the political regimes of Muslim countries is part of a process of reform of the political power of those states which has its origin in the Nahda [Renaissance] that these countries initiated since the 19th century. Since their beginning these reforms saw in the occidental world their source of inspiration if not of pure and simple importation.

But the reformers of the Muslim World are constantly nagged by one question: “ Is this occidental model on which the awakening of the Muslim World depends compatible with the precepts of the shari’a”?

Until today, this question has never ceased to torment the minds in this part of the world. This fact explains the tension that characterizes the reform process of the Muslim World since the 19th century, a tension between the imperatives of Modernity and all their implications concerning the status and the role of religion in the exercise of political power but also between the concept of the individual and his relations with the society and the political power on the one hand, the precepts of Islam on the other.

Landmark decisions of the Tunisian constitutional judiciary

The modern history of Tunisia shows us the remarkable presence, since the 19th century, of a strong constitutional consciousness, expressed as well in the discourse of claiming rights as in the official language. It is even possible to speak of a Tunisian constitutionalism.

In spite of this historical basis the institution of an organ that controls the constitutional character of statutes is of very recent date still largely imperfect.

In fact, the Tunisian Constitutional Council is a young institution created in 1988. Its contribution to the crystallisation of fundamental principles of Tunisian Law is still at its very beginnings.

But it is possible to detach a certain number of principles that the Council has either proclaimed, reaffirmed or clarified. These principles are held together by the task of combining in one system the relations between public institutions on the one hand, the fundamental rights of individuals on the other.

5. Thursday, November 13, 9:00 - 9:30 am
Changes in the Family Law from 1950-2008: the case of Malaysia (Abdul Hamid MOHAMAD)

Malaysia is a Federation of 13 States. The Federation provides the legislative lists for the Federal Parliament and the State Legislative Assemblies. While most laws are a Federal matter and within the jurisdiction of the common law courts, Islamic law, including family law, is a State matter within the jurisdiction of the Shari’ah courts. To avoid conflict of jurisdictions between the two courts, the Federal Constitution was amended. However, while some jurisdictional issues have been settled by the Federal Court (Supreme Court), some issues still persist and require legislative intervention.

With the establishment of the Shari’ah courts, laws, procedural and substantive, had to be codified. Procedural laws, civil and criminal, of the common law courts were adopted, with necessary modifications to make them Shari’ah-compliance. In the codification of the law of evidence and family law, laws from both sources were adopted even though a large portion of which were from the Shari’ah source.

I foresee that Muslim majority countries will adopt principles of both common law (or civil law) and the Shari’ah and that there will be a disintegration of the mazhabs within the Shari’ah itself.

The evolution of Family Law in Morocco from 1950 to 2008 (Miloud Laksir)

The presentation deals with the evolution of family law in Morocco across three distinct periods in the history of Morocco.

1. Before Morocco became a French protectorate in 1912.
-Islamic Law and traditional rules were applied to Moroccan Muslims;
-Moroccan Jews had their own courts governed by Jewish family law;
-Foreigners living in Morocco were governed by their national family Law or by the provisions of bilateral agreements.

2. During the French Protectorate.
-Islamic Judge remained in charge of the implementation of Islamic family Law as far as Moroccan Muslims were concerned;
-As for Moroccan Jews, they continued to be ruled by the principles of Jewish family law;
-Modern courts were established for non-Muslim foreigners to deal with their family cases, except for the Americans whose cases were considered by American consulates.

3. The period during which Morocco has been independent.
-In 1958, the first Family code was adopted and was amended in 1993, in particular its provision concerning marriage and matrimonial supervision;
-The year 2001, saw a major step forward accomplished in Morocco through the establishment of a Royal commission Chaired Chief Justice Dr Driss DAHAK, with the mandate of conducting a comprehensive revision of the provisions of the family code in force then. The four-year work of the Commission resulted in the drafting of a new family Law which was adopted by Parliament in February 2004.
-The provisions of the new Law stressed among other things, the principle of equality between husband and wife concerning the conclusion of the marriage contract.

It also placed the issue of divorce and marriage with more than one wife, under the court’s control strengthened the rights of the child and eased procedures regarding alimony.

The growing influence of the judiciary in the fields of marriage, maintenance, divorce and succession: the role of family jurisdictions

Before the French protectorate was established in Morocco in 1912, Islamic law was applied in the country according to the Malikite rite. Then judges were appointed by the King in his capacity as Commander of the Faithful and the King would review decisions under special circumstances.

During the Protectorate period, the French introduced in Morocco, civil, criminal, commercial and property laws. However Moroccan Islamic law judges continued to be in charge of the implementation of Islamic law in cases concerning personal status, succession and properties without a title.

Furthermore, Moroccan Jews have their own judges who apply to them Jewish religious law. As to the French and other foreigners, residing in Morocco their family relations are governed by the provisions of the Royal Decree of 1913, which is still applied to non-Muslim foreigners.

When Morocco gained its independence, a code of personal status was introduced in 1958 and was amended in 1993. Then, in 2004, the present family Law of Morocco was adopted and entered into force.

The presentation consists of four parts: marriage, divorce, maintenance and succession. Each part will feature specific laws and how they were implemented by judges and how through this exercise, the Judiciary influenced the legislator in changing those laws.

Filiation and integration into the family of the orphaned child: an alternative approach (Walina Cheikh MAOULAININE)

The presentation will have two sections:

Section one will deal will the filiation of the child, the means to establish filiation, which are married life, confession of the father, and sexual intercourse by mistake (Choubha). This section will also touch on recourse concerning filiation through anathema oath and acknowledgement of fatherhood.

Section two will focus on the integration of the orphan into the family in the light of the Moroccan family law and other laws.

Tunisia did not proclaim the idea of laïcité in the text of its constitution, as Turkey did, but she has nevertheless opted for a positivist definition of its legal order.

In fact, in proclaiming the principle of the sovereignty of the people, a people that makes law through a parliament which it elects directly, Tunisia recognizes indirectly that the state is the only source of law and that the shari’a is limited to the role of a material source of law.

However, in its first article, the Tunisian Constitution proclaims also:” Tunisia is a free, independent and sovereign state. Arabic is its language and Islam is its religion”.

This ambiguity of the constitutional text inspires the question whether there is a possibility of a third way between a laic and a theocratic state.

Family Law is the privileged place for the unfolding of the sharia, even in states that want to demark themselves from it. In analyzing some court decisions on the liberty to contract marriage and on inheritance we will try to show the direction in which the consciousness of the Tunisian judge, reflecting without doubt the collective Tunisian consciousness, has – even if hesitatingly –developed. Starting with the idea that the shari’a can legitimately unfold in the law of a state that claims to pertain to Islam it has recognized the concept that Islam is but one characteristic of the society. Consequently, the judge who works out solutions to conflicts that refer to personal status law has to take into consideration or even make prevail other political values that have been given the status of legal rules of the highest rank.
