Government Case vs. Orly Taitz is Weak

Government attorneys, your tax dollars, are being used to defend Soetoro Obama's case against Orly Taitz and her plaintiffs. I am not able to predict the outcome, since the case is so heavily politicized, but the government's case seems weak. Their first defense is that after the election any objections are moot because they should have been dealt with already under the Constitution, by the presidential Electors, and is up to the Legislative branch. None of this makes any common sense whatsoever. It assumes everyone responsibly performed their duties. The lawsuit filed seeks a redress of a wrong. The government has no case. Lieutenant Jason Freese and some other plaintiffs in the case claim they have a real injury because they are serving in the military and the commander-in-chief does not qualify as president under the Constitution. I would think that injury or death following orders of an unqualified commander would constitute genuine injury but this is post-Obama America after all and common sense does not predominate. Alan Keyes is a three-time presidential candidate who ran most recently in 2008 and Gail Lightfoot, was a vice presidential candidate in 2008. The government's bases their position on the opportunity to win. The argument is that is that they could not win so they are not injured. They may lose on popularity but I do not believe that weakens their legal argument one iota. The less popular candidates qualified under the Constitution which constitutes genuine injury by an unexamined, though popular, candidate. What I find quite interesting is the government’s position is that any person lacks standing to challenge a potential usurper to the POTUS under Article II, Section 1 Clause 5 even though he is not legitimate under the Constitution. If an election took place by fraud the Court should entertain an interest. Winning by fraud does not make it legitimate.


The case will be heard tomorrow in Santa Ana, California.

Obama Repeating Mistakes of Great Depression

A new study endorsed by Nobel laureate James Buchanan provides an alarming view of Obama's failed policies. Charles K. Rowley, Duncan Black Professor of Economics at George Mason University, and general director of The Locke Institute has concluded that "it is not impossible that the US will experience the kind of economic collapse from first- to third-world status experienced by Argentina under the national socialist governance of Juan Peron." In an important new monograph, Rowley and co-author Nathanael Smith, also from the Locke Institute, warn that Obama is making the same mistakes that led to the Great Depression.

What's Wrong With Obama Chatting Up the Kids? Plenty!

Obama is bypassing parents who may challenge his statements.

Obama should not use children as his personal pawns and he should abide by the rule of law.

According to Mathew D. Staver, founder of Liberty Counsel as well as dean of Liberty University School of Law, the address may be illegal. The Department of Education is governed by statute: 20 U.S.C. § 3403 states,


"No provision of a program administered by the Secretary or by any other officer of the Department shall be construed to authorize the Secretary or any such officer to exercise any direction, supervision, or control over the curriculum, program of instruction, administration, or personnel of any educational institution, school, or school system."


Staver's concerns were echoed by the Texas Justice Foundation who warned that the "classroom activities" suggested by Obama's speech were illegal.

According to a statement by the Foundation:


"The questions, comments, evaluations and analysis that occurs before, during, and after the president's speech will clearly 'reveal information concerning political affiliations' and probably, 'critical appraisals of other individuals with whom the child(ren) has/have close family relationships' (such as parents)."


"This is perhaps one of the greatest invasions of personal privacy and injecting political affiliation into the public school system in the history of the United States," the Foundation statement added.

The group cited the Pupil Rights Amendment:

"It also violates 34 Code of Federal Regulations Section 98.4[c] [1] and [2] that defines psychological testing as:

(1) Psychiatric or psychological examination or test means a method of obtaining information, including a group activity, that is not directly related to academic instruction and that is designed to elicit information about attitudes, habits, traits, opinions, beliefs or feelings;

(2) Psychiatric or psychological treatment means an activity involving the planned, systematic use of methods or techniques that are not directly related to academic instruction and that is designed to affect behavioral, emotional, or attitudinal characteristics of an individual or group.

Foundation officials said the group activities suggested by the Department of Education "are not directly related to academic instruction and that are designed to elicit information about attitudes, habits, traits, opinions, beliefs, or feelings."

Obama's political agenda violates the constitutional right of parents to direct the upbringing and education of their children, federal law, and is perhaps the greatest intrusion of a president into the education process in the history of the United States. "In the opinion of the Texas Justice Foundation lawyers, it is both morally and legally wrong."

"Federal law expressly forbids the Secretary of Education or any officer from exercising 'any direction, supervision, or control over the curriculum, program of instruction, administration, or personnel of any educational institution, school, or school system,'" the Foundation analysis stated.

The law states:

It is the intention of the Congress in the establishment of the Department to protect the rights of State and local governments and public and private educational institutions in the areas of educational policies and administration of programs and to strengthen and improve the control of such governments and institutions over their own educational programs and policies. The establishment of the Department of Education shall not increase the authority of the Federal Government over education or diminish the responsibility for education which is reserved to the States and the local school systems and other instrumentalities of the States. (b) Curriculum, administration, and personnel; library resources


No provision of a program administered by the Secretary or by any other officer of the Department shall be construed to authorize the Secretary or any such officer to exercise any direction, supervision, or control over the curriculum, program of instruction, administration, or personnel of any educational institution, school, or school system, over any accrediting agency or association, or over the selection or content of library resources, textbooks, or other instructional materials by any educational institution or school system, except to the extent authorized by law.

The lesson plans are seriously flawed, although the Department has back peddeled and revised items.

However, students as young as kindergarten will, nonetheless, be asked: "Why is it important that we listen to the president?" and then, initially, were to be asked to write about "what they can do to help the president." Their writings would later be used to make students accountable to their goals.

As WND reported, worksheets provided by the U.S. Department of Education encouraged teachers to ask pre-K through 6th-grade students the following questions:

* What is the president trying to tell me to do?

* What is the president asking me to do?

* What new ideas and actions is the president challenging me to think about?


Students may be asked to write down "key ideas or phrases that are important or personally meaningful, make posters of their goals, create a "supportive community" by sharing those goals with one another.

Junior-high and high-school students may be asked to brainstorm answers to the following questions before the speech:

* Why does President Obama want to speak with us today?

* How will he inspire us?

* How will he challenge us?

* What might he say?

The children are encouraged to talk about how Obama has inspired them or challenged them to do something.

The cult of personality promoted by Obama in the class has elicited a backlash. In addition to boycotts, or parents opting their children out of the propaganda, some students will wear black arm bands which was the same type of student protest of the Vietnam War that was upheld by the U.S. Supreme Court.

Obama Denies God and Country Fly-over, 1st in 42 Years



There is no promotion of Islamic issues therefore I see no reason why Obama would promote a traditional American tradition. Obama has stated publicly that the Muslim call to prayer is the most beautiful sound he has ever heard. And, bear in mind that in his Cairo speech he stated clearly he views his role as president to defend Islam. Obama stated: "I consider it part of my responsibility as president of the United States to fight against negative stereotypes of Islam wherever they appear."

Obama's Communist adviser, Van Jones, resigned after feeling the heat from talk shows and Internet reporting went viral. What is Wrong With Obama Chatting With Students?

There are at least three major problems with Obama's scheme to manipulate America's education through our children:

1. the usurpation of state and local jurisdictions, by the federal government, animating this scheme;
2. the manipulative nature of teacher-student behavior, to be carried out before and after the speech;
3. and, the content of Obama's speech.

Military Trained to Quell American Protest



As Blog Smith has reported for some time, the unprecedented move to use American military troops as police and to quell legitimate protest protected by the Bill of Rights has proliferated. In a recent exercise, soldiers at Fort Lee Virginia conducted what is described as an anti-terrorism drill. The drill would not be alarming and stopping terrorists should not be controversial. However, as seen in the exercise itself, protesters carrying signs are depicted. Am I stating the obvious here? Terrorists do not carry signs depicting their right to petition the government for a redress of their grievances: natural-born citizens and American citizens do. The military is training to quell legitimate, American protests against the regime. This is wrong and is unconstitutional. For example, one of the signs read "“racist free zone.” Racism also tends not to be a terrorist priority. This is not a anti-terrorist drill; this is a drill directed against American citizens.


Fort Lee Chief of Police Joe Metzger stated that in times of emergency the military and the police must work together. “We forget one’s wearing blue, one’s wearing a uniform. We all come together for the same cause.”

Apparently that cause involves the prevention of people exercising their First Amendment rights.


In June the Department of Defense anti-terrorism training course material states that the exercise of First Amendment rights in the US constitutes terrorist activity.


The ACLU wrote a letter of protest to the DoD regarding its Antiterrorism and Force Protection Annual Refresher Training Course, which advises personnel that political protest amounts to “low-level terrorism”. All DoD personnel are required to complete the course on a yearly basis.

Teen Unemployment Highest Since 1948



Teen unemployment is at the highest rate it has been since 1948. America formerly was a country known for its youth and opportunity with a freshness and brashness not characteristic of other countries but Obama is causing the sheen to come off America. If the job prospects are not good for most people, since unemployment is at a 26 year high, the unemployment rate is even gloomier for teenagers. This is not the best time to be young in America.

Why Does Obama Want Direct Access to Your Children?

I know how Barry Obama's spin went in regard to propagandizing the kids on the 8th but I wonder if his earlier legislative efforts are the real reason. The local school boards were not contacted, a serious breach of protocol, and by deliberately cutting the local school boards, and the superintendents out of the loop by contacting principals directly, Obama is essentially bypassing the voters, including parents. He is establishing a precedent for federal control of the children, for making them wards of the federal authority.


On 27 September 2007, then Senator Obama introduced the “Positive Behavior for Effective Schools Act” in the Senate. Obama’s education bill, S.2111, significantly redesigns and amends the Elementary and Secondary Education Act to allow, in part, for “State . . . local educational agencies, and schools to increase implementation of early intervention services particularly school-wide positive behavior supports.”

According to Section 3, “the term `positive behavior support’ means a systematic approach to embed proven practices for early intervening services, including a range of systemic and individualized strategies to reinforce desired behaviors and eliminate reinforcement for problem behaviors, in order to achieve important social outcomes."

Section 5 called: “Teacher and Principal Preparation to Improve School Climate,” mandates a new requirement for teachers and principals. It is described as “an understanding of social or emotional, or both, learning in children . . . such as positive behavior support.” Obama’s bill also provides for “instructional leadership skills to help teachers” satisfy this requirement.

In Section 8 Obama’s bill creates what’s called the “Office of Specialized Instructional Support Services” which shall “administer, coordinate, implement, and ensure adequate evaluation of the effectiveness of programs” via a new “Director” who provides “continuous training and professional development opportunities for specialized instructional support personnel” comprised of “school counselors, social workers, psychologists, and others.” These “instructional support personnel” provide “assessment, diagnosis, counseling, educational, therapeutic, and other necessary corrective or supportive services” for students.

Obama’s bill intends to extract–without restrictions from Title I funds. The bill “re-designates” funds to allow State educational agencies to “allocate funds to develop and implement coordinated, early intervening services (including school-wide positive behavior supports) for all students, including those who have not been identified as needing special education (emphasis CFP) but who need additional academic and behavioral support to succeed.”

Obama’s bill did not specify the “systematic approach” he plans to “embed” in America’s students to achieve the “desired behaviors” or “important social outcomes” his legislation mandates. Inquiries to former Senator Obama’s Presidential campaign and now to the White House to define them have thus far gone unanswered.


Perhaps Obama should explain to parents exactly what he means before he addresses America’s unwitting school children this Tuesday. In other times and in other regimes they called this indoctrination. What shall we call it?

This is quite staggering; the WHO (World Health Organization) released information stating that influenza is purposely released to cause a pandemic and thus speed up the regulatory process:
"When testing these mock-up vaccines, it is very possible to release the novel influenza virus into the population, as its purpose is to “mimic the novelty of a pandemic virus” and “greatly expedite regulatory approval.”


There is reason not to trust the WHO and scare tactics of the pharmaceuticals who profit from these shenanigans.

I Have a Hall Pass

After calling the Department of Education and my local school district in order to object to Barry Soetoro Obama's propaganda address I needed a follow-up exercise. Michelle Malkin




and the National Tea Party Coalition have posted a nifty idea: "Operation `“Hall Pass on That.”'




There are effective ways to counter the White House propaganda. The local school district states: "The study guides and objectives provided [by the Department of Education] in advance of the address contain learning activities that compliment elements of the (insert local school district name) Strategic Plan." I find it curious that the text of the address will not be released until the 7th; yet, the school district finds it complimentary to the Strategic Plan. How do they know that if they do not know what will be said?


The Hall Pass suggests: "Request meeting with the school board, superintendent, and principal to inquire as to why parents were excluded from the decision-making process of this event."


The more objections, the more concerns they field, the more reluctant they will be to simply agree with dictates handed down by the White House.


The suggestions are thoughtful:


alternatives there are for the children of families who wish their students learn about the establishment of the country respective to the Founding Father’s intentions. Discussion can focus on the Constitution, the definition and actions of a republic, and the responsibility of elected leaders to their constituents.


The Tea Party suggestion allows parents and local initiatives to take precedence in their area and allows them to enter the classrooms with sound suggestions and Constitutional learning.

American taxpayers are sending profits to European green companies according to a story released by the Wall Street Journal. The stimulus bill increased profits, not for Americans or created jobs here, but the windfall from taxpayer's money went overseas to Europeans.

Today we became aware of a video that was placed on the internet which has been reported in the media. The video is of a class of students singing a song about President Obama. The activity took place during Black History Month in 2009, which is recognized each February to honor the contributions of African Americans to our country. Our curriculum studies, honors and recognizes those who serve our country. The recording and distribution of the class activity were unauthorized.

On page 1004 it describes what the term "data" means in paragraph 1, section B:

including claims data, patient survey data, standardized
analytic files that allow for the pooling and analysis of
data from disparate data environments, electronic health
records, and any other data deemed appropriate by the

In Section 2521 of the Bill labeled "National Medical Device Registry", a class II device is defined as:

Along with this phrase is best seen in conjunction with "Class II" device usage:

On these days, Muslims wish each other “eid mubarak,” the phrase featured in calligraphy on the stamp, which translates as “blessed festival” or “may your religious holiday be blessed.”

Eid al-Fitr marks the end of fasting during the Muslim holy month of Ramadan with prayers, feasting, exchanging gifts, and visiting family and friends. Signifying “The Feast of Sacrifice,” Eid al-Adha occurs approximately two months and ten days after Eid al-Fitr. Eid al-Adha comes at the end of the hajjae, the annual period of pilgrimage to the holy city of Mecca and commemorates Ibrahim’s willingness to sacrifice his son Ismail. The stamp was developed with the help of Muslim consultants and experts in Islamic studies.

Employing traditional methods and instruments to create the stamp’s design, Arlington, VA-based calligrapher Mohamed Zakariya chose a script known in Arabic as thuluth and in Turkish as sulus. He describes it as “the choice script for a complex composition due to its open proportions and sense of balance.”

Zakariya used homemade black ink, and his pens were crafted from seasoned reeds from the Middle East and from Japanese bamboo from Hawaii. The paper was specially prepared with a coating of starch and three coats of an alum-and-egg-white varnish, then burnished with an agate stone and aged for more than a year. Zakariya’s black-and-white design was then colored by computer. The colors chosen for the stamp — gold script on a blue background — evoke great works of Islamic calligraphy from the past.


America traditionally has had a separation of church and state which does not seem to apply to the mosque thus with Obama we can expect more promotion of Islam during his regime.

Her argument is that the only way the country can succeed is if we can prove to the world that our ways have changed and only with Obama will we regain our status as a nation.


Watson is just nonsensical.


KABC’s Michael Linder was the reporter at a town hall health care debate at Wade AME Church when Democrat Watson made these astonishing comments.


If her comment about electing someone from Kenya was not enough, Watson continued with praise for health care in Castro’s Cuba and the Cuban revolution.

Obama to Seize Control of Net in "emergency"

A second draft of a bill, S. 773, that would allow Obama to seize control of the Internet during an "emergency" is little better than when first proposed. The most serious objection to the plan, simply from a security viewpoint, is that the bill does not ensure safety at all. So what is really at stake in Senator Rockefeller's draft?


"It is unclear what authority Sen. Rockefeller thinks is necessary over the private sector. Unless this is clarified, we cannot properly analyze, let alone support the bill," stated Larry Clinton, president of the Internet Security Alliance, which counts representatives of Verizon, Verisign, Nortel, and Carnegie Mellon University on its board. Even Obama has admitted that the government is not prepared for an emergency. So why should the government be given more power since it has thus far not been responsible about security matters?


The government has been exceedingly lax about internet security. An new cybersecurity coordinator position supposedly would reflect a high degree of White House concern about the field. Yet, three months later, that post remains empty, one top cybersecurity aide has quit, and some pundits have wondered why a government that receives failing marks on cybersecurity should be trusted to instruct the private sector what to do.


The Electronic Frontier Foundation, an industry watchdog group, has already gone on record by expressing concerns about privacy for citizens. If the government regulates the internet, then the federal government will have access to all financial, health, and private data on individuals.


Section 201 permits a president to "direct the national response to the cyber threat" if necessary for "the national defense and security." The White House is supposed to engage in "periodic mapping" of private networks deemed to be critical, and those companies "shall share" requested information with the federal government.


This is a vaguely worded but unlimited access to private networks by the federal government. It is unprecedented in a free society to allow government agencies unlimited surveillance and the viewing of all personal and private data.


Most troubling, there are no limits on what the government can do when seizing control of the internet. This is a bad bill that should be killed in Rockefeller's committee and never see the light of day.

As many people growing up and politically inclined such as myself we learned a great deal about public affairs from people like Ted Kennedy. Those assembled in Hyannis Port, Massachusetts advised the younger brother of JFK in order to salvage his political career from another Kennedy escapade. He was involved in a car accident, with 28 year old Mary Jo in his care, yet for ten hours he reported the mishap to no official agency. This was a Regatta Weekend reunion party at a friend's cottage with all married men (except one) and six women--the "boiler room girls"--the loyal staff who had worked together on Robert Kennedy's 1968 presidential campaign. After a binge of sailing and heavy drinking, Kennedy drove his black Oldsmobile sedan off a small wooden bridge into Poucho Pond, trapping Kopechne in seven feet of water. He did not notify any officials. Kennedy--only 38 and up for re-election the following year--had violated one of the cardinal rules in politics: "Never get caught with a dead girl or a live boy." In his celebrated defense speech on 26 July 1969, Kennedy delivered the television speech that saved his senatorial seat. Speaking to the nation for just 13 minutes he justified his actions and in the next election campaign he handily won 62% of the vote. Previous to the incident though 79% of Americans polled thought him the next Democratic nominee. It was not to happen. Five days after the accident, Kennedy's lawyers arranged for him to plead guilty to leaving the scene of the accident involving personal injury with a two-month suspended sentence and one-year probation. That was his only slap on the wrist unless you count the odds against him that prevented him from attaining higher office. Many of us were horrified when they learned that rescue workers found Mary Jo's body in the well of the back seat with her head held up, perhaps indicating that she had been alive for some time breathing in an air pocket. If only Kennedy had had the guts to turn himself in a timely manner. She might have lived.


So how could I mourn for Kennedy? Nothing he did ever equaled that one fateful night that Mary Jo died and I learned a great deal about American politicians. The only curse the Kennedy's have is the one that they bring upon themselves. Kennedy was so blind to his faults he joked about Chappaquidick.


This is not an accusation from Ted Kennedy's political opponents, but a nostalgic remembrance by one of his friends. Ed Klein, former Newsweek editor, tells the Diane Rehm Show:


"I dont know if you know this or not, but one of his favorite topics of humor was indeed Chappaquiddick itself. And he would ask people, have you heard any new jokes about Chappaquiddick? That is just the most amazing thing. Its not that he didnt feel remorse about the death of Mary Jo Kopechne, but that he still always saw the other side of everything and the ridiculous side of things, too."
